Commission Shuts Down Sherman Builder for 10 Years, Fines $5,000

(AUSTIN) — At its October 6, 2008, meeting, the Texas Residential Construction Commission approved an agreed order against Shakers Construction and Remodeling and Sharon Reneau for multiple violations, including publishing false and misleading advertisements, misappropriating construction trust funds from homeowners, acting as unregistered builders, failing to timely notify the commission of a judgment entered against them and failing to properly register homes with the commission.
The commission took action jointly against the company and Reneau, acting as the primary designated agent for the company. Wesley Akers and Shakers Construction Company were also directly involved in the violations, so they were also included in the agreed order.
Eight other builders were fined for various infractions, including failures to renew registrations, to file required paperwork with the commission, to pay inspection fees, or to reimburse the commission for payments made from accounts with insufficient funds to cover the transaction. Commission Executive Director Duane Waddill said the commission’s actions further demonstrate its commitment to enforcement.
“All these companies failed in some way to fulfill their obligations to Texas consumers and the commission took action to prevent similar failures in the future. Shakers Construction and Ms. Reneau’s multiple violations warranted the highest penalty the commission can levy — they are effectively barred from working in the Texas homebuilding industry for a decade.
“The commission works very hard to help ensure quality construction for Texans. Sometimes, the best way for the commission to reach this goal is to deny a builder the ability to work in the industry in Texas for an extended time. This was the case with Ms. Reneau, Mr. Akers and Shakers Construction,” Waddill said.
The commission’s Web site, www.texasrcc.org, provides Texas consumers useful information as to whether a builder or remodeler is registered, if the commission has confirmed defects in any homes built by that builder/remodeler and if the commission has fined or otherwise sanctioned that builder/remodeler.
