| Commission Issues $45,000 in Fines; Revokes One Builder

( Austin ) - Penalties approved by the Texas Residential Construction Commission at its April 2007 meeting are now finalized and have been officially levied against the sanctioned builders/ remodelers.
The registration of Rey P. Hernandez Construction, of San Angelo , was revoked and he was fined $20,000 for using fraud and deceit to obtain his registration, as well as having an unpaid judgment and failing to register homes properly.
The following builders were all cited for presenting checks to the commission that later were not honored by their financial institution for a lack of sufficient funds. The fine amount is in parenthesis: MC Construction, of Missouri City ($5,000); Spazio Construction, Inc., of Laredo ($5,000); Bolar Builders, of Austin ($5,000); Davenport Development Group, of Heath ($5,000) and Stacy and Carla Bateman Family, LP, of Lindale ($5,000).
Commission Executive Director Duane Waddill said builders and remodelers must understand that the commission will hold them responsible for any failure to obey the law or to adhere to commission rules.
"I fully expect Texas builders and remodelers to honor their legal and moral obligations to consumers and the state," Waddill said. "The commission is aggressively investigating and sanctioning those builders and remodelers to ensure they take their responsibilities seriously in the future. The industry must recognize the commission's commitment to enforcing the laws and rules regulating residential construction in Texas ."
Consumers can research whether or not a builder or remodeler is registered and if the state has found a defect as a result of a consumer complaint and how many projects a builder or remodeler has registered by utilizing the public record search on the commission's Web site at www.texasrcc.org.
