Texas Attorney General Secures Injunction for Commission Against Unregistered Builder |
(Austin) — The Texas Residential Construction Commission’s denial of a registration for Adrian Frazier has been backed up in court with a permanent injunction.
Frazier, an unregistered builder doing business as Artside Custom Homes in Fort Worth and Arlington, was denied a registration by the commission in June 2007. Rather than abide by the law, Frazier continued to work as a builder without proper registration.
The Office of the Attorney General (OAG) filed a lawsuit on behalf of the commission against Frazier to obtain an injunction to prevent her from continuing to operate as an unregistered builder. A temporary injunction was entered by the 98th Judicial District Court of Travis County, Texas, in Texas Residential Construction Commission v. Adrian Frazier d/b/a Artside Custom Homes. On February 28, 2008, the court signed an order for an agreed permanent injunction.
Commission Executive Director Duane Waddill said the ruling should have a chilling effect for those builders and remodelers continuing to work illegally in Texas, citing both the attorney general’s office’s involvement and recent legislative action that gives the commission new tools to stop illegal builders from operating in Texas.
“This is the first permanent injunction against an unregistered builder in Texas, but it will certainly not be the last time the commission takes such action to protect consumers,” he said. “While the commission is grateful that the Office of the Attorney General took up and won this case, House Bill 1038’s new mandates give us the authority to stop illegal builders without the Attorney General’s assistance. We will be using every weapon in our arsenal to protect Texas consumers from unscrupulous builders.”
The injunction prohibits Frazier and anyone acting with or working for her from illegally operating a residential construction company. It also prohibits her and her associates from advertising for residential construction and accepting money as compensation for residential construction, unless she first becomes registered as a builder with the commission. The injunction also provides that the commission may perform reasonable inspections if the commission has reason to believe that she is continuing to be illegally engaged in residential construction.
